Property purchase procedure

According to the law on ‘property purchase by foreigners in Turkey’ enacted on January 7, 2006, foreign real persons and commercial companies having legal personality established in foreign countries according to the laws of those countries will able to acquire real estate in Turkey on the conditions of being reciprocal and complying with legal restrictions. In implementation of the reciprocity principle, it is essential that real estate acquisition rights given by a foreign country to its own citizens and to commercial companies established in foreign countries according to the laws of these countries are also given to the citizens and commercial companies of the Republic of Turkey.

  • Once you have made the decision to purchase a property and agreed the price & conditions with Kaya Homes, you will sign a contract.
  • At this time if you don't plan to spend a considerable time in Turkey it would be beneficial to give a limited "power of attorney" to Kaya Homes to conclude all the legal aspects of the purchase on your behalf. Alternatively, Kaya Homes can refer you to an English speaking solicitor for any advice if you feel it necessary.
  • To secure the purchase of your property you will be required to make a deposit payment of 2000 GB pounds upon signing the contract.
  • The payment plan as agreed with Kaya Homes and confirmed in the contract would follow and you will be given our bank details to enable you to transfer the future payments.
  • Before you leave Turkey, we will assist you obtaining a tax number from the Tax Office in Manavgat, to open a bank account enabling you to transfer interim and final payments.
  • An application is made to the Land Registry Office to start procedures for Military permission (this process may take a couple of months). Parties or their legal representatives go in person to the Land Registry Office for conveyance upon receipt of the military permission. A Certified Translator is required when one of the parties is a foreign national
  • When your permission has been received and the TAPU (Title Deeds) are ready for issue you don't need to be present in Turkey. Your solicitor will sign the Title Deed on your behalf and the deed will be transferred into your name. At this time, you are required to pay 4% of the purchase price shown on the land title deed as tax and Tapu Expenses.
  • If you are not in Turkey at that time we will scan and mail them to you.
